NOTICE OF INTENT TO AWARD A SOLE SOURCE / LIMITED-SOURCE DELIVERY ORDER TO WESTLAW PUBLISHING 1. Purpose of Notice The Department of the Treasury, Treasury Common Services Center (TCSC), on behalf of the Financial Crimes Enforcement Network (FinCEN), intends to issue a sole source firm-fixed-price delivery order to West Publishing Corporation, doing business as West, a Thomson Reuters business, under FEDLINK Contract No. LCFDL23D0027 for Westlaw Advantage online legal research subscriptions. This notice is prepared for posting to SAM.gov as a notice of intent and is not a request for competitive quotations or proposals. 2. Description of Requirement FinCEN requires continued access to Westlaw Advantage online legal research subscriptions for 30 authorized agency users. The subscription includes Westlaw Advantage National Primary, Analytical Plus, Litigation, Practical Law, and Government Contracts Counselor content. The requirement supports legal research, procurement, compliance, and mission support needs of FinCEN users and requires uninterrupted access by September 30, 2026. The contractor shall provide the subscription content and Westlaw Advantage training at no additional cost to the Government, including self-paced online training and one-on-one custom training with the contractor account management team. 3. Intended Source The intended source is West Publishing Corporation, doing business as West, a Thomson Reuters business, 2900 Ames Crossing Road, Suite 100, Eagan, MN 55121. The proposal identifies West Publishing Corporation as the legal contracting entity and identifies UEI L997DB4PEJL8 and CAGE Code 89101. 4. Authority and Regulatory Basis The acquisition is contemplated as a sole source delivery order under the FEDLINK indefinite-delivery vehicle. The Contracting Officer shall use the final authority applicable to the selected ordering procedure and include the completed limited-source, sole-source, brand-name, or exception-to-fair-opportunity documentation in the contract file. For an order under an indefinite-delivery contract, the draft basis is FAR 16.505(b)(2)(i)(B), because only one awardee/source is capable of providing the supplies or services required at the level of quality required due to the unique and highly specialized proprietary Westlaw Advantage content and functionality. To the extent the action is treated as other than full and open competition outside FAR 16.505 ordering procedures, FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements, supports the sole-source rationale. Public notice is prepared consistent with FAR Subpart 5.2, including FAR 5.201 and FAR 5.207 requirements for synopses of proposed contract actions, as applicable. 5. Rationale for Sole Source / Limited Source Westlaw Advantage is proprietary to West Publishing Corporation/Thomson Reuters. The required content and functionality include Westlaw Advantage National Primary, Analytical Plus, Litigation, Practical Law, Government Contracts Counselor, KeyCite, West Key Number System, Westlaw editorial enhancements, AIpowered legal research tools, and associated online legal research functionality. FinCEN currently relies on the Westlaw Subscription Service for online legal research. A lapse in access would create mission and schedule risk for users who rely on the platform for legal research, procurement, compliance, and mission support. Market research did not identify another source capable of providing the required proprietary Westlaw Advantage subscription content. The requirement is not suitable for a small business set-aside because the required content is proprietary and available from West Publishing Corporation through the FEDLINK vehicle. 6. Period of Performance and Estimated Value The anticipated period of performance is a 12-month base period from September 30, 2026, through September 29, 2027, with two 12-month option periods through September 29, 2029. 7. Response Instructions Interested parties may identify their interest and submit a capability statement demonstrating their ability to provide the content and functionality of the Westlaw Advantage subscription described in this notice. Capability statements must include evidence that the respondent can provide the proprietary content, authorized user access, training/support, technical capability to train employees. Responses must be submitted electronically to the Contracting Officer\Contract Specialist identified in the SAM.gov notice no later than September 17, 2026. The Government will not reimburse any costs associated with preparation or submission of capability statements. A determination by the Government not to compete this proposed action based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
